Law of Public Procurement

Ever since the EU directives on opening markets were transposed into national law, the importance of public procurement law has snowballed. Our efforts are primarily concentrated on laws awarding building contracts (VOB/A) and those awarding professional and other services (VOL/A and VOF).

We advise and represent our public clients to ensure that the national and pan-European public procurement they realise conforms with the legal provisions. Here, we resolve the essential questions of any legal obligation to call for tenders before turning to which procedure should be used. Furthermore, we draft commercially reasonable conditions for the public tender. In providing advice, we focus on the strictly formal requirements imposed by public procurement. If necessary, we also defend the procedure used to award the contracts and the tender decision before courts of law.

We assert the rights of all our private-sector clients as tenderers in public procurement procedures.

Currently, we experience a special need for legal advice in cases in which public companies have expanded their commercial activities into areas that were previously the reserve of private-sector companies.
